According to the Supreme Court, Texas Cannot Restrict Federal Agents from The Border!
CNS News–In a significant legal development, the U.S. Supreme Court has issued a ruling that orders Texas to grant federal border agents access to the state’s border with Mexico. This decision comes as Texas officials deployed extensive lengths of concertina wire along the border.
The Supreme Court’s 5-4 order did not provide detailed explanations for the justices’ decisions. However, it effectively upholds longstanding court rulings that establish the federal government’s sole responsibility for border security, as dictated by the Constitution.
Last year, Texas initiated a lawsuit against the federal government after Border Patrol agents cut portions of the concertina wire along the Rio Grande. The state argued that the Department of Homeland Security had interfered with Texas’ border security efforts and damaged the state’s property.
The Supreme Court’s recent order vacated a previous injunction from the 5th U.S. Circuit Court of Appeals that had prevented Border Patrol agents from cutting the concertina wire. The ongoing standoff between Texas and the federal government over immigration enforcement has intensified in recent weeks.

Shelby Park in Eagle Pass has become a focal point, with Governor Greg Abbott increasing border enforcement measures around the park, including surrounding it with razor wire and restricting access. Abbott’s Operation Lone Star initiative, which began in 2021, has heightened tensions between the state and federal government.
The operation has involved the deployment of state troopers, arrests of suspected trespassing migrants, installation of concertina wire along the Rio Grande, and the construction of border walls. As migrants attempted to navigate the wire, Border Patrol agents cut parts of the barrier to assist injured individuals. Attorney General Ken Paxton filed a lawsuit against DHS, alleging that federal agents had unlawfully destroyed state property.
A U.S. district court judge initially ruled in favor of the federal government, stating that Border Patrol agents had not violated any laws. Paxton’s office appealed the decision, and a panel of judges from the 5th Circuit temporarily paused the ruling until the appeals process concluded.
The situation escalated on January 12 when National Guard members blocked federal border agents from accessing the Rio Grande after several migrants drowned while attempting to cross the river. The federal government accused Texas of hindering their efforts, while Texas disputed this account.
