A letter dated January 26, signed by FHSMV Deputy Executive Director Robert Kynoch, effectively reverses a previous policy that facilitated the updating of gender markers on driver’s licenses post-transition, without necessitating proof of gender-affirming surgeries.
The crux of the new policy lies in the interpretation of ‘gender’ as synonymous with ‘sex’, defined by biological and genetic characteristics. This interpretation underpins the assertion that altering gender markers based on gender identity constitutes fraud, thereby subjecting individuals to potential criminal and civil liabilities, including imprisonment, fines, and revocation of driving privileges.
Critics, including civil rights attorney and LGBTQ+ activist Alejandra Caraballo, argue that this policy not only erases legal recognition of transgender individuals but also criminalizes their existence in Florida. The implications are far-reaching, potentially affecting an estimated 94,900 transgender adults in the state, as highlighted by Equality Florida.
