The Indiana Attorney General talks about the brief that was filed in the double murder case in Delphi.
In October, Special Judge Fran Gull fired Richard Allen’s defense team because they were careless and let a lot of evidence slip out.
Now, lawyers Andrew Baldwin and Brad Rozzi are asking the Indiana Supreme Court to let them back in.
Rokita says that the judges should say no to their request because it is “very unusual.”
“We didn’t take sides for the judge or against the judge, or for the defense team or not for the defense team,” says Rokita. “We simply informed the court, as a friend of the court, what Indiana law has been in this regard.”
It’s not clear when or if the state Supreme Court will decide on Rozzi and Baldwin’s requests to go back to Allen’s defense or to have Gull taken out of the case completely.
As already said, Tippecanoe County officials are working on a law that will stop people from sending more than 5 million gallons of water out of the county every day.
Because the state wants to bring water from Lafayette to an industrial park that will be built near Lebanon.
Commissioners say they are ready to go to court to defend the ban.
Rokita says he has to serve Indiana by law, even though he knows the pipeline is not a popular idea in Greater Lafayette.
“I’ll do my statutory duty. … I’m also elected,” he states. “That’s purposefully done so that I’m ultimately accountable to the people, so I will have to balance those different demands.”
