A Texas woman is being charged with a felony for reportedly leaving her newborn baby wrapped in plastic in a dumpster. While the police were investigating, she is said to have told them she did this to keep her relationship with her boyfriend.

A charging document seen by PEOPLE says that 18-year-old Everilda Cux-Ajtzalam was arrested and charged with the criminal crime of abandoning a child in Harris County, Texas, on July 21.

According to a probable cause document received by PEOPLE, Cux-Ajtzalam, who works at a food truck in Houston, gave birth to her child “on the ground” behind the food truck where she works. “The child was born the same day it was found,” the police told KHOU 11.

In the next step, Cux-Ajtzalam is said to have put the baby, along with the placenta and umbilical cord, in a trash bag and thrown the bag into a bin.

It is said that the child was left “tied inside the trash bag,” but a stranger heard the baby crying and called 911, saving the child.

The police say that Cux-Ajtzalam was caught later that week.

According to the affidavit, she reportedly told police that she “had no other choice” but to kill the baby this way during the investigation because she didn’t want her boyfriend to break up with her.

Police said that the event was caught on close surveillance footage but did not give any other information.

The report says that the child was taken to a nearby hospital.

“It was pure luck that the child was found and got care,” a judge told KHOU 11 during Cux-Ajtzalam’s court date on Friday.

An emergency protection filing that PEOPLE looked at shows that a Harris County magistrate has given a protective order against Cux-Ajtzalam that says she can’t be within 200 feet of the child.

As of now, Cux-Ajtzalam has not made a plea. A lawyer named in court records told PEOPLE that they are still looking over the case, which was given to them this morning.

The police say that Cux-Ajtzalam is being held on a $200,000 bond.
