This law, mirroring similar legislation in states like Montana, North Carolina, and Virginia, includes a unique provision: websites must display a warning from the Texas Health and Human Services Commission about the alleged dangers of p*rnography, including claims of addiction and cognitive impairment.
However, the legitimacy of these claims and the involvement of the Texas Health and Human Services Commission (HHSC) are under question. According to 404 Media’s investigation, the HHSC disclaimed any involvement in crafting or endorsing these statements. This revelation emerged following a public records request, to which the HHSC responded with “no responsive documents,” indicating no official communication about the law.
The law’s implementation has been tumultuous. Following its passage, some websites briefly displayed the mandated health warning, only to remove it amidst ongoing legal disputes. A coalition of adult entertainment entities, including major websites like P*rnhub and XVideos, filed a lawsuit against the state, challenging the constitutionality of the law.
While a district judge initially blocked the law’s enactment, Texas Attorney General Ken Paxton’s appeal resulted in the Fifth Circuit issuing a stay on the injunction. Critics argue that the law’s lack of enforcement in Texas and similar states cast doubt on the alleged crisis it purports to address.
