CNS News– Texas Attorney General Ken Paxton has initiated legal action against five cities in Texas, including Austin, San Marcos, Killeen, Elgin, and Denton, in what is being dubbed as his “anti-cannabis crusade”. Paxton’s lawsuits target policies implemented by these cities that he argues violate Texas laws concerning marijuana possession and distribution.
The lawsuits stem from the cities’ adoption of amnesty and non-prosecution policies, approved by voters in 2022, instructing law enforcement not to enforce Texas drug laws related to marijuana. Paxton contends that these policies are at odds with laws enacted by the Texas Legislature, citing the Texas Local Government Code and the state Constitution.
Paxton has been vocal about his opposition, stating, “I will not stand idly by as cities run by pro-crime extremists deliberately violate Texas law and promote the use of illicit drugs that harm our communities.” He emphasizes the importance of upholding the law and seeks to hold accountable those whom he perceives as disregarding it.
The cities named in the lawsuits, despite being home-rule cities with the authority to establish local ordinances, are challenged by Paxton’s interpretation of the Texas Local Government Code, which prohibits entities from adopting policies that result in the non-enforcement of drug-related laws.

The ordinances in question received significant support from voters, with Austin garnering an overwhelming 85% of votes in favor, followed by San Marcos with 82%, Elgin with nearly 75%, Denton with 71%, and Killeen with close to 70%. As of now, the cities have yet to issue a formal response to the lawsuits.
Paxton’s actions represent a significant development in the ongoing debate over marijuana legalization and decriminalization in Texas. The outcome of these legal battles will likely shape future drug enforcement policies in the state and influence broader discussions on drug policy reform nationwide.
