The current state of gambling legislation in Texas is marked by significant opposition from Republican senators, despite efforts to introduce casino and sports wagering bills. Lt. Gov. Dan Patrick has publicly stated that there is insufficient support among Senate Republicans to advance such legislation. For a bill to move forward in the Texas Senate, which consists of 31 members, at least 21 senators need to vote in favor.
This requirement implies that nine Republicans would need to join 12 Democrats to endorse any gambling expansion. Patrick, who has the power to set the Senate’s agenda, emphasizes the need for at least 15 or 16 Republican senators’ support to avoid the perception of a Democrat-led initiative.
Among the bills under consideration is Senate Joint Resolution No. 17, proposed by Sen. Carol Alvarado, which aims to establish up to four “destination resorts” in Texas, along with smaller casinos at horse and dog tracks, and the introduction of casino games and slots at tribal gaming properties.
Notably, some Republicans, including Texas Gov. Greg Abbott and House Speaker Dade Phelan, appear more open to expanded gambling. The House, in general, is viewed as more amenable to approving casino and sports betting legislation compared to the Senate.
One argument in favor of legalizing sports betting is the widespread nature of illegal betting in the state. It is estimated that Texans wager over $6 billion on sports annually. Illegal betting, being unregulated, cannot be taxed, thus denying the state a potential revenue source. During a legislative hearing, Rep. Jeff Leach highlighted the prevalence of illegal, unsecured betting, including by minors, especially during events like March Madness.
Proponents of gambling expansion, including representatives from major Texas sports teams and the PGA Tour, argue for the economic benefits, citing a potential 10% tax on adjusted gross wagering revenue. However, opposition voices, like Jonathan Covey from Texas Values and Cindi Castilla from Texas Eagle Forum, raise concerns about gambling’s potential to lead to family violence, addiction, and financial instability.
The casino sector, including major players like Las Vegas Sands, is actively lobbying for commercial gaming in Texas. Over 300 lobbyists are working in the state to advocate for the gambling sector, with significant campaign contributions made to key Republican leaders.
