The KS Supreme Court Upholds the Murder Verdict from October 2020!
CNS News– In a unanimous decision, the Kansas Supreme Court has upheld the conviction of Todge Anderson for first-degree murder in a 2020 shooting homicide and robbery case. The court affirmed Anderson’s convictions for first-degree felony murder, aggravated robbery, distributing or possessing with intent to distribute a controlled substance, and criminal possession of a weapon.
The charges stem from an October 2020 incident where Anderson, along with two accomplices, robbed and murdered Christopher McMillon, reportedly over a debt owed to Anderson. The accomplices testified against Anderson during the trial.
One of the key points of contention was the admission of a jail call recording where Anderson mentioned being shorted in a drug deal. Anderson argued for the exclusion of this call due to late disclosure by the state, but the court deemed its admission reasonable under the circumstances.
The court also found sufficient evidence to support Anderson’s conviction for distributing or possessing with intent to distribute a controlled substance. Despite objections regarding comments made during the prosecutor’s closing argument, the court concluded that any errors did not affect the verdict.

However, the court identified an error in the district court’s order requiring Anderson to pay $5,000 in attorney fees to the State Board of Indigents’ Defense Services. The district court did not sufficiently consider the burden this payment would impose on Anderson. Consequently, while affirming the convictions, the court vacated the attorney fees order and requested the district court to reassess the fees following the ruling.
