The lawsuit, demanding $708 million, centers on the costs incurred by New York City in housing and providing services to these migrants.
The legal basis of the lawsuit is a provision in New York’s Social Services Law that penalizes entities for knowingly bringing individuals in need of public assistance into the state, arguing that these actions intentionally aim to overwhelm New York’s social services system.
The lawsuit articulates that the bus companies, by aligning with Governor Abbott’s plans, have effectively shifted the financial burden of migration at the southern border to New York City. Mayor Adams emphasized the city’s readiness to manage the humanitarian crisis but criticized the political strategies of Texas, which he viewed as reckless and inhumane.
New York Governor Kathy Hochul has also expressed support for the lawsuit, accentuating the need for the companies involved to assume responsibility for their actions in this crisis.

Abbott maintains that the migrants traveled voluntarily and were authorized by the Biden administration to remain in the United States, hence asserting their constitutional right to travel across the country.
