The Texas Attorney General Petitions the Supreme Court to Ban Abortion!

Ken Paxton, the attorney general of Texas, has asked the state’s highest court to stop a woman in Dallas from getting an abortion. Just before midnight on Thursday, Mr. Paxton’s office asked the court to do something after a judge in Travis County gave Kate Cox a temporary restraining order that let her end her unviable pregnancy.

The Texas Tribune reported on Friday that he also sent a letter to three hospitals in the state threatening to sue them if they let the abortion happen. The judge’s ruling was the first of its kind since Roe v. Wade was overturned, and it went against the state’s strict anti-abortion laws.

Kate Cox’s baby was found to have full trisomy 18. Her lawyer, Molly Duane, said that the baby might not live through birth, and if it does, its life would only last minutes, hours, or days. It’s important for Mr. Paxton that the Texas Supreme Court decides the case quickly because “each hour remains in place is an hour that Plaintiffs believe themselves free to perform and procure an elective abortion.”

The filing said, “Nothing can bring back the life of the unborn child that will be lost as a result.” “Post hoc enforcement doesn’t work, so time is running out.” Lawyers for 20-week-pregnant Ms. Cox said that the only choices she had in Texas—an abortion or a C-section—could both make it harder for her to have children in the future because she had two C-sections already.

While crying in court on Thursday, Judge Maya Guerra Gamble said, “The idea that Ms. Cox desperately wants to be a parent and that this law might take away her ability to do so is shocking and would be a real miscarriage of justice.”
